Distance Sales Agreement
ARTICLE 1 – PARTIES
This Distance Sales Agreement (“Agreement”) has been concluded electronically between the Seller, whose details are provided below, and the Consumer who makes a purchase via www.bahadiroglubaharat.com (“Website”).

CONSUMER
The Consumer's name, surname, delivery address, billing address, phone number, and e-mail address consist of the information provided during the order process.
ARTICLE 2 – SUBJECT OF THE AGREEMENT
The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the products ordered electronically by the Consumer via the Website.
The basic characteristics, quantity, sales price, campaign details (if any), delivery information, and payment details of the product subject to the Agreement are presented to the Consumer at the stage where the order is created and in the order summary.
ARTICLE 3 – PRODUCT, PRICE, AND PAYMENT
3.1. The name, quantity, unit price, and total sales price of the product subject to sale are displayed to the Consumer during the order process.
3.2. Product prices are valid as of the date the order is created, unless otherwise stated.
3.3. The total amount regarding the order; The total amount payable—including the product price and any applicable shipping, delivery, or other additional costs—is clearly displayed to the Consumer at the payment stage.
3.4. Payment may be made using a credit card or debit card via the secure payment infrastructures provided on the Website.
3.5. Card payment transactions are processed through the secure infrastructure of the authorized payment service provider. The Seller does not store the Consumer's full card details.
ARTICLE 4 – DELIVERY
4.1. Orders are prepared following the successful completion of payment, based on product stock status and the nature of the order.
4.2. Domestic orders are generally prepared and handed over to the shipping carrier within 1–3 business days. Products handed over to the carrier are generally expected to be delivered within 1–5 business days.
4.3. International orders are generally prepared and handed over to the shipping or logistics company within 1–5 business days. For international orders, the total delivery time may generally vary between 5–15 business days, depending on the destination country, shipping method, customs procedures, and other operational conditions.
4.4. Delays resulting from causes beyond the Seller's control—such as customs procedures, official inspections, shipping volume, flight or transport schedules, and similar factors—may affect the delivery time.
4.5. In cases where delivery of the order is not possible, the Consumer shall be informed, and the necessary actions shall be taken in accordance with applicable legislation.
ARTICLE 5 – RIGHT OF WITHDRAWAL
5.1. In distance contracts, the Consumer has the right to withdraw—without providing a reason and without paying any penalty—within fourteen days from the date the goods are delivered to the Consumer or to a third party designated by the Consumer, subject to the exceptions stipulated in the legislation.
5.2. The Consumer may exercise the right of withdrawal via a clear notification or through other methods stipulated in the legislation.
5.3. In cases where the right of withdrawal is applicable, the return process shall be carried out in accordance with applicable legislation once the withdrawal notification reaches the Seller.
ARTICLE 6 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL REGARDING FOOD PRODUCTS
6.1. Since the products sold via the website are food products, the exceptions to the right of withdrawal stipulated in the legislation may apply, depending on the nature of the product.
6.2. In accordance with applicable legislation, the right of withdrawal may not apply to products that are perishable or have a short shelf life.
6.3. The right of withdrawal may not be exercisable for products where the packaging, protective tape, seal, or similar protective elements have been opened after delivery, and where return is unsuitable for health or hygiene reasons.
6.4. For products not falling under the exceptions to the right of withdrawal, the Consumer’s right of withdrawal and other statutory rights arising from applicable legislation remain reserved.
6.5. The Consumer’s statutory rights regarding the choice of remedies for defective, damaged, incomplete, or incorrectly shipped products remain reserved.
ARTICLE 7 – RETURNS AND REFUNDS
7.1. In cases where the right of withdrawal is applicable, product returns shall be carried out in accordance with applicable legislation.
7.2. Refunds made within the scope of the right of withdrawal shall be processed within the timeframes stipulated by legislation and via the same payment method used by the Consumer at the time of purchase.
7.3. For refunds of payments made via credit or debit card, the time required for the refund initiated by the Seller to be reflected in the Consumer’s account may vary depending on the processing times of the relevant bank and payment institution.
ARTICLE 8 – DEFECTIVE, DAMAGED, OR INCORRECT PRODUCTS
8.1. In the event that the ordered product is damaged, defective, incomplete, or incorrect, the Consumer may notify the Seller of the situation via bahadiroglubaharat@gmail.com.
8.2. Depending on the nature of the issue, product replacement, a refund, or other legal remedies stipulated by legislation shall be applied. 8.3. If the Consumer detects damage to the package that is clearly visible at the time of delivery, it is recommended that they notify the delivery personnel of the situation—to the extent possible—prior to delivery and have a damage assessment report drawn up. However, this recommendation does not negate the Consumer's statutory rights.
ARTICLE 9 – INTERNATIONAL ORDERS
9.1. For international shipments, delivery times may vary depending on the destination country, shipping method, customs procedures, and the import regulations of the relevant country.
9.2. Unless otherwise specified, any customs duties, import taxes, fees, and other official charges applicable in the destination country for international orders are the responsibility of the buyer.
9.3. Delivery issues arising from customs regulations or import rules regarding international orders shall be evaluated in accordance with the legislation of the relevant country and the nature of the order.
ARTICLE 10 – OBLIGATIONS OF THE PARTIES
10.1. The Consumer acknowledges that the name, surname, delivery address, telephone number, e-mail address, and billing information provided during the order process are accurate and complete.
10.2. The Consumer is responsible for any delivery issues arising from incorrect or incomplete information provided by the Consumer.
10.3. The Seller is obliged to deliver the products subject to the order in accordance with the conditions specified in the contract and applicable legislation.
ARTICLE 11 – FORMATION AND STORAGE OF THE CONTRACT
11.1. The Contract is concluded electronically once the Consumer confirms the order and completes the payment process.
11.2. Information regarding the order and the Contract may be stored electronically by the Seller in accordance with applicable legislation.
11.3. The Consumer may retain the order and contract information via the e-mail or similar durable data storage media sent to them following the order.
ARTICLE 12 – DISPUTES
12.1. For transactions carried out in the capacity of a consumer under this Agreement, the legislation in force regarding consumer protection shall apply.
12.2. The Consumer may exercise their legal rights before Consumer Arbitration Committees and Consumer Courts, subject to the nature of the dispute and the monetary limits established for the relevant period.
12.3. The Consumer's mandatory statutory rights are reserved.
ARTICLE 13 – EFFECTIVENESS
This Distance Sales Agreement enters into force upon the Consumer confirming the order electronically and completing the payment process.
The Consumer acknowledges having read and accepted the Agreement and having received the preliminary information regarding the order prior to placing the order.
